Examine how Miller creates dramatic tension Essay

Examine how Miller creates dramatic tension in the ‘yellow bird’ scene of The Crucible and consider how an audience might react Arthur Miller’s play, ‘The Crucible’, is set in Massachusetts in 1692, where mass hysteria led to the Salem witchcraft trials. The same kind of situation occurred in the1950s resulting in the Anti-Communist frenzy of that time known as McCarthyism. In my essay I intend to examine how Miller creates tension in the Yellow Bird scene by using dramatic effects to engage the audience in the play and keep them engrossed, involved and on the edge of their seats. At the beginning of act three, the mood is set by the stage directions and descriptions. It says, â€Å"the room is empty but for sunlight pouring in through two high windows in the black wall. † It gives the impression of solemnity and depression, and also makes the small room seem claustrophobic so the girls have nowhere to escape. This reflects the stifling society and the situation that the girls have got themselves into. The scene starts after Elizabeth has just lied to the court in order to protect her husband, which is a quiet scene. When the court starts accusing the Proctors, Hale stands up and shifts the blame on to Abigail, as he is the only person except for John Proctor who can see what is going on, apart from the audience who would now start to become a little frustrated. Abigail then creates a diversion by screaming and looking up towards the rafters. The stage directions say, â€Å"with a weird, wild, chilling cry, screams up to the ceiling. † She knows that she is in danger of the truth being exposed and tries to divert the attention from herself. Everyone is now staring at Abigail, the characters and audience not knowing what is going on. Gradually, the other girls join in as they understand what Abigail is doing and they put on a very convincing act to Danforth and the audience, which is very frustrating, as we know that she is guilty and now trying to get away with it. A yellow bird is mentioned and the girls pretend that they can see it on the beams and behind the rafters, while Proctor shouts that there is no yellow bird. Abigail starts to talk to the bird, to ask why it has come, to keep up the pretence of the dramatic situation. Mary’s name is mentioned, Abigail pretending that Mary is possessing the yellow bird as the devil and she screams, â€Å"My face? My face† to the ceiling, making it seem that she is the victim. Mary immediately springs to her feet and protests in shock, pleading Abigail to stop with the deception and to tell the truth. Abigail says that she cannot stop because it is God’s work that she does and this creates even more frustration and hatred towards Abigail from the audience because we know that Mary is innocent and Abigail is such a convincing liar. The other girls pick on the a trance and Mary gets more and more agitated as she cannot defend herself against the large cluster of girls in hysteria. They act like bullies, ganging up on her because she is weak and the tension builds up, as Mary gets more and more distressed. The girls start mimicking Mary, which is a typical playground-bullying device, which is guaranteed to undermine her. Abigail targeted her as she chose to confess and she will do anything to get her way, as she is frightened that Mary would reveal the truth. They then advance further to imitating Mary’s actions – stamping feet and shaking fists, strengthening the tension, and maddening the audience even more with aggravation. When the other girls copy Mary Warren’s actions, there is a lot of movement involved, which intensifies the frustration that the audience are feeling and the girls cannot go back on their decision to follow Abigail as they are all trapped in their own deceit. The audience are unsure whether Mary will give in or not as she is so weak and we already know how manipulating Abigail is. Mary protests and eventually weakens and starts whimpering like a wounded animal as she is overwhelmed by the conviction that she was being possessed by the devil in the form of the yellow bird Abigail conjured up. Danforth bullies Mary into speaking, â€Å"Speak! Will you speak! † and Proctor and Hale try to reveal the truth as the voice of sense. The whole scene climaxes with Mary out screaming all the other girls in pure desperation of them imitating her. This makes all the girls stop in astonishment creating a silence, which contrasts the noisiness with the quietness. Mary goes over to Abigail, who gives a look of triumph, as she finally succeeds in what she set out to do, by manipulating the situation to her advantage. Proctor loses his temper as Mary sides with the other girls in order to get herself out of the troubling situation and she claims John Proctor is the ‘Devils Man’. The audience are in dismay, as we know that Proctor is one of the only decent men and that he is in fact innocent. The scene ends with Proctor losing his temper and chaos starts as Hale tries to make Danforth see sense that Proctor is blameless and Abigail is the malicious one. Hale leaves the court and the scene ends with Danforth shouting to him to come back, leaving a cliffhanger into Act 4. Danforth became hysterical towards the end as a result of the chaos occurring. The continued action through the scene keeps the audience on the edges of their seats and feeling like they are part of the play, which keeps them interested and involved, because they are feeling the emotion and distress as Proctor and Hale are so they feel as though they are going through the dramatic situation with them. The vast amount of action keeps the scene moving and there is always something happening as when ever the situation is diverted, Abigail steps in and takes the Yellow bird to another level. The short, sharp sentences during the scene also contribute largely to the tension building up and everyone is cutting over each other’s sentences, which creates the idea of more chaotic occurrence. The negative words that are used by Abigail and against her create a negative atmosphere, for example. â€Å"I cannot stop! She sees nothing, mustn’t, never, don’t don’t. † Also John Proctor makes references to biblical allusions to stick with religion on the good side to help him get people to believe his innocence, â€Å"God damns all liars†, and â€Å"Angel Raphael† even though he is the one person least likely to be involved in organised religion. Watching this scene made me frustrated and agitated as the situation becomes so out of hand as Abigail puts on such a brilliant act to ensure that the attention is not on Proctor and Hale who are trying to reveal that she was behind all the accusations right from the beginning. This is also how I feel an audience would react as I reacted in that way every time Abigail took the situation to another level and manipulating everyone until she reaches her target of getting Mary Warren on her side and against John Proctor. I really enjoyed the play even though it was a sad ending.

America’s Women Suffrage Movement in Unit two

In unit two, American women made history by enduring the longest women political movement in America. One political issue they faced and which led to the movement was the denial of a right to suffrage which means they had no right to vote in general elections. They occupied the traditional position in the society and had no say in the running of the government. They were to be subjective to men and remain stuck in domestic chores. An attempt to defy from this was met with utter hostility. In response to these issues, women in America organized groups aimed at garnering for the women rights and recognition in the society.Most prevalent were the women suffrage movement groups which sought to secure the right for women in America to vote in the general elections. The outcome of that was severe opposition both from the society and the government before the nineteenth amendment which was eventually passed to give women the right to suffrage. Many would describe 1877 to 1920 as the age in which America was being shaped into a modern world. This period was a fascinating as well as a turbulent one as new discoveries and innovations kept the American economy advancing. Government institutions received a major facelift and its functions became more specialized.It is during this time that the advancement in labor took a major turn and the capital grew at a high rate following technological advancement and increase in trade and business. The women however still felt economically and politically oppressed as they continued being deprived of an opportunity to participate in these exciting developments. Their roles rotated around domestic chores and there were little chances of working or even obtaining some education. This paper will address the issues that women faced and the formation of the women suffrage movement to campaign for women rights.Analysis The political as well as social issues facing the women could have been said to be oppressive. Their voice was irrelevant as far as the society was concerned and therefore they did not have to vote during the general elections (Keller, 2003). Their place was in domestic affairs and had little if any chance to acquire an education. When it came to work, women were discriminated against and they could not take up jobs such as teaching and preaching (Keller, 2003). A few elite women felt that enough was enough and they were determined to end this once and for all.Women rights organizations were set around America to address these issues. The three major organizations that undertook the campaign for women suffrage included the National Women Suffrage Association, the American Women Suffrage Association and the Congressional Union for Women Suffrage Association (Kerber and De Hart, 2000). The introduction of these organizations marked the beginning of a contentious fight that would eventually see women cast their votes in general elections by 1920. It was not an easy fight and numerous challenges faced the movement from the beginning.Women leaders were arrested and subjected to torture in the arms of policemen during demonstrations (Crawford, 2001). Their propositions were constantly rejected by the Senate and men formed anti-suffrage movements to stop the women from campaigning. The National Union Opposed to Women Suffrage was also an obstacle to the developments. However, the women finally met their objective when the Senate eventually voted for the nineteenth amendment in 1920 which would allow women to vote in the general elections (Du Bois, 1999). Background of the women suffrage movementThe birth of the women suffrage movement can be traced back to 1848 during the Seneca Falls convection in New York (Joannou, 1998). However, it was not until 1869 that the first women suffrage organization was formed. The Seneca convection had been organized by Lucretia Mott and Elizabeth Cady Stanton out of the desire to fight for the rights of women in the American society (Joannou, 1999). The two women had met in the World Anti-slavery Convection where together with other women were denied a chance to talk. Enraged, the two decided that there needed to be movement to fight for human rights.The discussions at the convection were centered on the notion that all women and men are created equally and there is no basis for women to be excluded from the voting process (Evans, 1989). The women suffrage movement had a clear cut objective; they intended to obtain a right to vote or suffrage for all the women in the United States. As it was during that period up until 1920 women were left out in the nation's decision making process because they were not allowed to choose the leaders that they wanted in the government (Frost-Kappman, 2005).Other objectives of the movement included equality in access to education and the right to earn a living through taking up jobs. Elizabeth Cady Stanton and Susan B. Anthony became the leading activists in this movement which questioned the subjug ation of women both politically and economically yet the state claimed that America was a democratic society (De Bois, 1999). Together with others such as Mary Ann McClintick, Lucretia Mott, Anna Howard, Carrie Catt, Lucy Stone and Julia Howe among others, they were determined that this fight would eventually be won (Adams, 2003).As way to publicize these outcries, The National Women Suffrage Association (NWSA) was formed in 1869 to campaign against the injustices to women. American Women Suffrage Association (AWSA) was also been established in the same year by Julia Howe and Lucy Stone (Adams, 2003). Each of these organizations worked independently with NWSA fighting for both women rights and women suffrage rights. AWSA on the other hand concentrated on the voting rights only. These two women groups conducted many campaigns and demonstrations in their bid to pressure the state to amend the constitution and accord women the right to vote.An attempt to pass an amendment to allow wome n suffrage in 1878 was severely thwarted when the proposal was rejected by the congress (Crawford, 2001). After conducting several negotiations following the realization that they could be better off working together, NWSA and AWSA joined to form NAWSA (National American Women Suffrage). Elizabeth Stanton and Susan Antony remained influential leaders in the newly formed organization with Stanton becoming its first president between 1890 and 1892 (Bell, 1911). Susan Anthony became president in 1892 and on her retirement in 1900 she was succeeded by Carrie Chapman Catt.Anna Howard took presidency in 1904 from Catt and was later succeeded by Catt who led the organization again from 1915 to 1920 (Bell, 1911). An organization known as Women's Social Political Union came to the limelight in 1913 formed by Alice Paul, Olympia Brown and Lucy Burns (Evans, 1989). Paul had just returned from studying in Britain intended to introduce military tactics such as the ones practiced by the Women's S ocial Political Union. Members started picketing and demonstrating outside State House which led to many arrests and a seven months imprisonment for Paul (Evans, 1989).She was however released after going on a hunger strike. All in all, the women suffrage movement went through its ups and downs until the desired objective was finally met. The Determined Fight The women suffrage movement encountered determined resistance as men vowed to do everything possible to stop the women. They believed that if the women got the right to vote then they would be equal to them; a reality they were not ready to accept. The convectional belief was that men should dominate the public sphere while women's sphere was confined in the domestic setting 9Adams, 2003).Women campaigners were treated with hostility by men who opposed this movement. A good example is when women who appeared in the parade that Alice Paul organized to seek national support for the amendment on Pennsylvania Avenue (Keller, 2003). This was the day before the inauguration of President Wilson and thousands of male spectators turned the peaceful parade into a riot as they tried to break into the marchers' ranks. Many were not lucky as they got hurt while trying to escape (Keller, 2003). This kind of incident just goes on to show the difference in culture between now and then.Men were willing to endanger the lives of their sisters and their wives so as to retain the power while women remained the objects of oppression and the direct victims of inequality. From the position given to women in those days, we can deduce that culture has evolved over time leading to the recognition of women as part of the society. Women now have rights equal to those of men as provided for in the constitution. This is what the leaders of AWSA wanted so much even though some like Susan Anthony and Elizabeth Stanton never got to enjoy the fruits of their labor (Joannou, 1998).The Pennsylvania Avenue incident coupled with others such as jailing of leaders and the force-feeding that they were subjected to in 1917 aroused huge public support from sympathizers and well wishers and is said to have attracted more male supporters for the movement (Adams, 2003). Several women did not support the movement as well and they maintained that women should keep off from politics since they were too beyond their understanding (Adams, 2003). Some claimed that such involvement would only serve to undermine their spiritual and moral roles.This can probably be as a result of the way women were brought up knowing that their rightful place is in the domestic arena. As a result, deviating from this would result in going against the rules of nature and consequently against rightful morality. Josephine Dodge whose husband was an influential New York capitalist is the one who introduced the biggest movement against women suffrage. This was the National Association Opposed to Woman Suffrage which came into being in 1911 (Kerber and De Hart , 2000). The movement called for women anti-suffragists to influence their men behind the scenes consequently influencing policy.This was a major throwback to the women suffrage movement which aimed at feigning collective support from all women so as to maximize the chances of accomplishing their objectives. The campaign was an uncertain and slow process as resistance continued to face the women suffrage movement (Adams, 2003). The effects however were being felt differently in every state such that different states in the US gave women a right to vote at different times during the movement (Evans, 1989). The state of Wyoming had been the first to give voting rights to women in 1869.In the second unit, several other states gained the rights to vote before the government eventually agreed to pass it as a law throughout America. Colorado obtained franchise in 1893 and immediately after, Idaho and Utah gave rights in 1896. Women in Washington were enfranchised in 1910 and from this tim e on to 1918, Kansas, Arizona, Montana, Nevada, Michigan, California and South Dakota among others had given women a right to vote. Victory at last The House of Representatives passed the women suffrage amendment in 1918.This was after President Woodrow Wilson declared that America needed to accept women suffrage urgently as a war measure (Keller, 2003). The motion was however rejected by the Senate so that the amendment was defeated yet again. Another attempt in 1919 February failed as well. It was not until June 1919 that the Senate finally bowed to the pressure and the nineteenth amendment was passed (Keller, 2003). This was later signed into law by the Secretary of State in August 1920 (Adams, 2003). This day marked the liberation of women in America and the women could now participate in the voting process. Significance of the women suffrageThe final outcome of the women suffrage movement was a victory worth reckoning. The American women had made history in one of the most pers istent politically inspired campaign (Cooney, 2009). The women suffrage movement can be said to have had an enormous impact on American politics and the meaning of democracy. Women in America could finally lend their voice in government decisions through their votes. The victory of women suffrage laid the basis of equality and democracy as we know them today (Cooney, 2009). The nineteenth amendment advocated for equal rights to vote and that no one would be discriminated on the basis of gender or race.This was a major breakthrough which the present women generation should hold dearly. Thanks to the woman suffrage movement, women today can vote and influence major policy decisions of the state. Had there been no women suffrage movement, women would have retained their inferior position in the society and they would have never been part of the democratic society through selecting their leaders. Not only was it a great achievement for the American women but also for women in the world who had not yet secured their rights to vote.The American experience encouraged them to fight on. Examples included United Kingdom, Philippines, Japan, Italy and Switzerland among others where women were allowed to vote in later years. Conclusion The women suffrage is one event that will remain a significant part of history for a long time. This is because it was a major breakthrough both in the country's democracy and in the position of women in the society. It reflects a determined fight on the part of the women leaders such as Elizabeth Stanton and Susan Anthony who exerted all their efforts into women liberation.The challenges that the women went through during this period and their willingness to endure is a reflection of the commitment that they had on the movement. NAWSA being the organization that lobbied for the support of women across the country played the role of pressuring the government to amend the constitution to include women as having equal rights to men. Even thou gh not many men supported the women suffrage movement, some were for the signing of the amendment as reflected during the voting done in the House of Representatives which most definitely consisted of men.The Senate also later agreed to side with the motion to support women voters. This change in perspective is a reflection of changes in culture that have occurred in history. From this, the women fraternity could now be included in the government decision making process by electing leaders whom they wanted to represent them. Cultural Diversity in Music and its positive and negative effects on Society Essay

American music is a melting pot of various genres of music. From the times when the country was colonized American music has come a long way. Rock and Roll, Hip-hop, Rhythm and Blues, Jazz and Country are among the internationally renowned genres. The more indigenous genres include Gospel, Louisiana tejoles, and Hawaiian music and American Folk music. Music intertwines with various aspects of American identity such as race, ethnicity, gender and social class. Of these race is perhaps the biggest driver of any particular genre of music. Hip-hop, jazz, soul and R&B have long been considered as an African –American tradition as has the country music genre been the tradition of whites in America. The mixing of cultures from has permeated popular culture in an unprecedented fashion. Because of its crossover appeal, music is a great unifier of diverse populations. It has gone from the fringes, to the suburbs, and into the corporate boardrooms. Over the last forty or fifty years music has been one of the biggest influential factors in teenage society. So, there’s no problem in assuming that our present adult society is built with some of the ideas taken from the music industry of the yesteryears. Positive Effects: Music in America has and continues to play a very positive role in the society. The emergence of folk music during the 20th century, and particularly the rise of popular folk music of the 1960’s, is probably the best example of music affecting society. The Civil Rights Movement was in full swing and the largely unpopular war in Vietnam was well underway. Folk music is, inherently, music played and sung by and for everyday people—music for the masses, so to speak. Naturally, when a culture becomes aware of radical changes that awareness gives way through expression. Folk singer and songwriter Woody Guthrie began writing â€Å"protest music† and songs in support of popular movements of the day. Other folk singers such as Bob Dylan and Joan Baez followed suit. For the first time, music was not only a vehicle for expression, but it was also a way to mobilize and inspire listeners to think differently and take action. Country music typically embodied idealistic thinking, shunning capitalism and material comforts. It is about everyday people doing everyday things-the bars they go to, the people they have lost, their dreams, their loves, and their friends. Country gives people something to relate to besides urban hip-hop, rap, heavy metal, and pop. As far as society as a whole, for the most part country singers are considered fairly wholesome-they aren’t in the tabloids for drugs and explicitly wanton behavior (not saying they don’t & they are all perfect! ) but their images tend to be cleaner than musicians belonging to other genres so it gives the younger generations people to look up to. Both Hip-Hop and R&B have impacted society in many ways, mainly well. R&B and Hip-Hop have, in their own way, addressed the challenges of African-American individuals, provided help and strength, and left an impact that has been widely debated throughout the years. Many people equate gangsta rap and other isolated artists or songs with all rap and, even worse, Hip-hop in general. This is a huge fallacy because 90% of rap is either something that helps society or at least something that doesn’t hurt it. Consider, for example, feminist rap. Feminist rap goes against any misogyny in other types of rap and forces society – especially men who objectify women—to take a step back and see that what is going on in the cases of gangsta rap is wrong. Another example of a form of rap that helps society is political rap. Political rap from artists such as Public Enemy encourage the black community to stand up for their rights and to become politically active so that they do not get taken advantage of. Rock musicians too have sometimes attempted to address social issues directly as commentary or as calls to action. During the Vietnam War the first rock protest songs were heard, inspired by the songs of folk musicians such as Woody Guthrie and Bob Dylan, which ranged from abstract evocations of peace Peter, Paul, and Mary’s â€Å"If I Had a Hammer† to blunt anti-establishment diatribes Crosby, Stills, Nash, & Young’s â€Å"Ohio†. Other musicians, notably John Lennon and Yoko Ono, were vocal in their anti-war sentiment both in their music and in public statements Negative Effects: The introduction of rock and roll music in the 1950’s brought with it the fear that its lyrics and new rhythms would adversely affect young listeners. That fear has carried over into the twenty-first century, but now the criticism is focused primarily on heavy metal and rap. It has been suggested that the lyrics in these types of music promote aggression, bigotry, deviant sexual activity, suicide, violence, drug use, and homicide. This issue also arises in the field of medicine. The American Academy of Pediatrics fears that rock lyrics are potential threats to the health and well being of adolescents. These concerns include pregnancy, drug use, sexually transmitted diseases, accidents, and suicide. Rap music is infamous for its inflammatory remarks towards women. Thus the two most popular forms of music for adolescents revolve around themes of disrespect and sexual imagery. Furthermore, the effects music lyrics have on mood, suicidal ideation, aggression, and stereotyping have been questioned. The massive popularity and worldwide scope of rock and roll resulted in an unprecedented level of social impact. Far beyond simply a musical style, rock and roll influenced lifestyles, fashion, attitudes, and language in a way few other social developments have equaled. From its beginnings, rock and roll has been associated with youth, rebellion, and anti-establishment. The blend of black influences, suggestive lyrics, and wild response by the younger set made rock and roll appalling and threatening to the older generation. The ability to shock the elders in turn became part of the appeal of the music to young generations. The rock and roll lifestyle was popularly known as being associated with sex and drugs. Many of rock and roll’s early stars (as well as their jazz and blues counterparts) were known as hard-drinking, hard-living characters; during the 1960s a decadent rock lifestyle became more publicly known, aided by the growth of the underground rock press which documented such excesses, often in exploitative fashion. Conclusion: The impact of American music on society is definitely a positive one. An artist’s music can be positive through lyrics by saying all the things the person listening wants to say. It can also inspire other people to do good things such as the song Imagine by the Beatles. Music enhances creativity. Writers block, it is said, can be cured by a bout of music listening. Although there has been a great deal of negativity that has centered on music, the positive far outweighs the negative. The negative effects of some genres of music, which are the commercialization of music, the loss of creative edge, and the sex, violence and misogyny, are over shadowed by positive effects like political awareness, societal awareness, anti-sexism, and racial awareness. It is imperative to consider both regimes, and my discussion would reflect both the common law remedy and the remedy in equity. Tracing at Law At common law, any individual with a legal title in property may be able to resort to tracing in order to recover it. Thus, this legal title, may be traced all the way to the newest form the property has taken after exchanging hands (for e.g where a defendant has bought a watch with the original property, cash). This phenomenon was described as a matter of hardnosed property rights and distinguished from an action in damages2, hence, any identifiable property was considered traceable and returned to the original beneficiary. Thus, the legal title is traced from one person to all successive individuals that came along the way until finally reaching the person against whom the action could proceed, providing a means to the remedy (Trustee of the property of FC Jones v Jones [1996]). In this way , it is regarded by the courts not as a remedy unto itself but as a means to a remedy, as seen in Banque Belge pour L'Etranger v. Hambrouck [1921]3. The first step then to a successful tracing action is to identify the defendant who is now in possession of the property. In the above case, where money was being traced, the defendant was identified as the fraudulent cashier who had deposited the money in a bank and used it to pay for his expenses. It was held that the cash even though it had the potential of being mixed with other funds, was identifiable in the account and could be recovered by Banque Belge. Once the defendant is identified, the next step is to proceed with a remedy which could be one of the following depending on the form of property being traced. If the property in question, as in the above case of Hambrouck, pertains to funds, then an action to recover ‘money had and received’ may be brought (Lipkin Gorman v Karpnale [1991])4. Commercial Entrepreneurship And Social Entrepreneurship In this session, I will discuss about the difference of commercial entrepreneurship and social entrepreneurship. Commonly, social entrepreneurs and commercial entrepreneurs are having similarity as well as differences. There will also certain issues regarding social entrepreneurship to be discussed in this session. This chapter will focus on the motivation factor of social entrepreneurship. There will also brief discussion about motivation of commercial entrepreneurship in order to shows the different motivation factor between two types of entrepreneurship. The first definition of entrepreneurship was defined at 250 years ago. The first crucial role of the entrepreneurship was first recognized by eighteenth century businessman Richard Cantillon (1931). He described entrepreneur as undertakers engaged in market exchange at their own risk for the purpose of making a profit. Dave Roberts and Christine Woods (2005) has defined entrepreneurship base on two perspective which included academic and practitioner. James Howard Jane (2006) stated entrepreneurship aims at creating profitable operations resulting in private gain. This contrast is, of course, overstated. Commercial entrepreneurship does benefit society in the form of new and valuable goods, services, and jobs, and can have transformative social impacts. Such transformations can even be a driving motivation for some commercial entrepreneurs. Kao (1993) has defined that Entrepreneurship is the process of adding something new [creativity] and something different [innovation] for the purpose of creating wealth for the individual and adding value to society. An entrepreneur has to be creative and innovative in order to have a sustainable growing business. In fact, entrepreneurs are considered as one of the main contributors to country economy growth. Entrepreneurial activity benefit community and society as it creates job opportunity, income, products and services with his creativity and innovation to us. 2.2.2 Role of Social Entrepreneurship Nowadays, Social entrepreneurship is likely to become more important than commercial entrepreneurship as there are many social problems occurred. Seelos and Mair (2005) defined social entrepreneur create models in order to fulfill basics human needs that existing marketing have failed to satisfy. Social entrepreneurs are having the mission to change society. James Howard Jane (2006), stated that social entrepreneurship as innovative, social value creating activity that can occur within or across the non-profit, business, or government sectors. They have further elaborated the concept for deeper understanding for the concept by developing four variables which are market failure, mission, resource mobilization, and performance measurement. To certain extend, social enterprises correct market failure whereby a problem for the commercial entrepreneur is an opportunity for the social entrepreneur. The authors have showed that proposition that market failure will create differing entrepr eneurial opportunities for social and commercial entrepreneurships. The Mission for the social entrepreneurship is aims to create social value for the public good by helping and benefits the public. Human capital for the social entrepreneurship will be a vital factor determining the success of social entrepreneurship. Usually, the economics of a social entrepreneurial venture often make it difficult to compensate staff as competitively as in commercial markets. Thus, employees who work for social enterprises often hope to receive non-financial compensation for their work. Human and financial resource mobilization will be a prevailing difference and will lead to fundamentally different approaches in managing financial and human resources. It would be difficult to measure the performance of a social enterprise just like commercial enterprise as we can measure it in terms of profitability and market share. Thus, performance measurement of social impact will remain a fundamental differe ntiator, complicating accountability and stakeholder relations. Yohanan (N.D) has differentiated two major approaches in the explanation on social entrepreneurship. Both major approaches stress on the social desirability of the initiatives studied, but there are some different aspects. The first approach by Brown and Letts (2004) is focused on intentions and outcomes. Social entrepreneurs put innovative efforts to solve persistent social problems of poverty and marginalization that, to some extent, have been successful in increasing their impact and catalyzing social transformation. Another approach which is done by Alvy and Lees (2000) is based on opportunities and needs. People who realize where there is an opportunity to satisfy some unmet need that the state welfare system will not or cannot meet and who gather together the necessary resources. 2.2.3 Social Entrepreneurship as Profit or Non-profit Organization? In the findings done by Pomerantz (2003), he stated that social entrepreneurship as the development of innovative, mission- supporting, earned income, job creating or licensing, ventures undertaken by individual social entrepreneurs, nonprofit organizations, or nonprofits in association with for profits. From his point of view, a social enterprise can either be non profit or profit generating organization. For example, Margaret Cossette used a grant of $ 400 to turn a small public-sector into not-for profit enterprise which provides home care for rural seniors in America. When needs or demand is increased, Cossette didnt have enough capital to cope with the situation. A NFP organization is not qualify for bank loans. Thus, Cossette turn her venture, Missouri Home Care, into the for-profit arena in order to apply for loans to expend her services. In fact, there are many more cases that clearly lie on the for-profit side of the divide but are readily serve as social entrepreneurship by reputable commentators. Fundamentally, social enterprise is nonprofit organization which benefits society without gaining any profit. However, Gregory (1998) states that there is increasing number of nonprofits have been seeking additional revenues by behaving more like for-profit organizations. For example, Save the Children, an international development agency, sells a line of mens neckwear. Such ventures are for generating the cash in creative way. The profitability is linked with social entrepreneurship for certain cases, but the social ends still remain the dominant goal of these ventures. In conclusion, a social enterprise can be either profit making or non-profit making organization. However, profit gained for social enterprise is mainly contributed for social purpose such as helping poverty and solving social problems. 2.3 Motivation for Entrepreneurship Motivation is one of the elements in influencing the process of entrepreneurship. Shane, Locke and Collins (2003) have differentiated the motivation factors into two groups which are general factors and task-specific factors. The general motivation factors, including need for achievement, locus of control, vision, desire for independence, passion, and drive. 2.3.1 Need for Achievement McClelland (1961) stated that individuals who have higher level in need for achievement (nAch) are will have higher desire to involve in activities or tasks that have a high degree of individual responsibility for outcomes. Entrepreneurial activity involves high responsibility and high risk. In order to have great achievement, entrepreneurs will like to take the challenge to start up and grow their business successfully. Hence, McClelland also argues that entrepreneurial roles are characterized as having greater degree of risk, skill and effort, as well as feedback on performance. From the Maslows hierarchy, entrepreneurs are individuals who are in the level of self-esteem or self-actualization. They desire for self-fulfillment as to be successful entrepreneurs. 2.3.2 Locus of Control Locus of control is the belief in the degree which individuals believe their actions or personal characteristics decide the consequences. Individuals who have an external locus of control believe that the outcome of an extent is out of their control, while individual with an internal locus of control believe that their personal actions directly affect the outcome of an event (Rotter 1966). Individuals with internal locus of control will like to play entrepreneurial roles because they desire positions in which their actions have a direct impact on results. 2.3.3 Vision An individual with the vision of creating a profitable firm can be motivated to be an entrepreneur. Vision is influenced and affected by cognitive factors such as knowledge, skills, and abilities (KSAs). The combination or integration of motivation and cognition will further create visionary action (Locke, 2000). Firstly, the entrepreneurs will need to have the knowledge regarding the sector or industry they want to invent into. Next, they will need to have the skills such as leaderships, bargaining and purchasing, market analysis, decision making, team building, planning as well as problem solving. Furthermore, the entrepreneurs need to have the abilities such as financial abilities and intelligence, too. Aligned with the KSAs, the entrepreneurs will have a realistic and achievable vision, including the strategy for the organization and manage it well. 2.3.4 Desire for Independence Individuals choose to start up their own business because they dont like to work for other people. They desire independence whereby they make decision by themselves, they choose their own path and life rather than living off the efforts of others. Many researchers have observed that the entrepreneurial role necessitates independence. First the entrepreneur takes responsibility for pursuing an opportunity did not exist before. External factor will indirectly become the driver of individual to develop own passion to become an entrepreneurs. 2.4 Motivation for Social Entrepreneurship 2.4.1 Altruism An entrepreneur who is altruistic will likely to start up social enterprise. This phenomenon is due to the willingness of the entrepreneurs to contribute and sacrifice one-self in order to benefit other. According to Williams, Wee Liang, and Teck Meng(2005), there are two type of social entrepreneurs in terms of the objective. The first type of social entrepreneur is having the objective to profit only society while the second type will be profit society and himself. The first type of social entrepreneur is obviously more altruistic than second. The first type of social entrepreneur will have even more altruistic if he is willing to accept personal loss. Below are the social entrepreneurs with six descending level of altruism: (1) The person who attempts to innovatively profit society alone, in a way that involves that society, at risk of personal loss. (2) The person who attempts to innovatively profit society alone, in a way that involves that society, at risk of foregoing personal profit. (3) The person who attempts to innovatively profit society by profiting himself, in a way that involves that society, at risk of incurring personal loss. (4) The person who attempts to innovatively profit society by profiting himself, in a way that involves that society, at risk of forgoing personal profit. (5) The person who attempts to innovatively profit himself by profiting society, in a way that involves that society, at risk of personal loss. (6) The person who attempts to innovatively profit himself by profiting society, in a way that involves that society, at risk of foregoing personal profit. Social entrepreneurs who share the same traits may differ in the social impact of their initiatives. Drayton (2002) stated that entrepreneurial quality (pg.124) is the key to distinguish the impact. Entrepreneurial quality is a very special and scarce trait. It is much more than altruistic motivation and other previously mentioned traits. It is the vital motivation to change the whole society shared by only a very small percentage of the population. 2.4.3 Behavior There are few behavioral attributes which have been associated with social entrepreneurship : courage to accept social criticism, less failure-anxiety, receptivity to others feelings, perseverance, communication skills, ability to appear trustworthy, creativity, ability to satisfy customers needs, foal oriented, and working capacity (McLeod, 1997; Prabhu, 1999). After all, these behavior can be applied to commercial entrepreneurial behavior as well. However, there is one exception which is the difference between commercial entrepreneurial behavior and social entrepreneurial behavior which is receptivity to others feeling, or in a simple word, empathy. Referring to the Websters dictionary, empathy is defined as the ability to share in anothers emotions or feelings. A social entrepreneur is caring and helpful. Mair and Noboa(2003) found that empathy can be considered as a trait (dispositional empathy) or a behavior(situational empathy). The authors then consider empathy as a cognitive and emotional antecedent. 2.4.4 Context and background In addition to traits and behaviors, context and background are also important aspects to understand entrepreneurs and their initiatives (Bird, 1988). The background and living of social entrepreneurs is having great impact on enabling the desirability for them to start up social enterprise (Prabhu, 1999). My parents raise me with the spirit of charity and giving, I felt uneasy about the problems of the poor and I am sensitive to other peoples feeling are common response of social entrepreneurs. Mair and Noboa (2003) argued that background and context explain a large part of social entrepreneurs enhanced level of loyalty to their values and philosophy, which is typically associated with an elevated level of moral judgment. A model of social entrepreneurial intentionsmodel of SE intentions.png Mair and Noboa (2003) have developed a model of social entrepreneurial intentions. They defined their independent variables as emotional: empathy (behavior), cognitive: moral judgment (Background and Context effect). These variables will then enable individual to have perceived desirability to develop behavioral intention such as receptivity for others feeling. When they have the behavior, they will have the social entrepreneurial behavior and they decide to start up social enterprise. There is another enabling factor such as self-efficacy and social support which will further develop perceived feasibility. After that, individual with perceived feasibility will enter the same routine as perceived desirability. Empathy and moral judgment are positively linked with perceived social venture desirability, while self efficacy beliefs and social support are positively linked with perceived social venture feasibility. 2.4.5 Opportunity Perception and Recognition Krueger, Kickul, Gundry, Verma, and Wilson, (2007) stated that mental models is the element that provide a set of attributes or characteristics that define what is considered as an opportunity. Perception of opportunity is categorized with two critical antecedents: (1) is the action expected to yield a net positive consequences or effects and (2) is the action actually within or beyond our control. Prevalence of needs in human society if often indentified as a major reason for the existence of social opportunity. According to Human Development report (2007,2005), there are nearly 3 billion people live below the poverty line, earning less than $2 per day. This phenomenon will bring a lot of negative effects such as starvation, increased criminal rate, and violence. For example, there are 50,000 deaths per day which are linked to poverty-related causes. (World Health Organization, 1999). The problem of poverty are observable and it creates many opportunity for social entrepreneurs. Beh avioural Theory stated that entrepreneurs aspiring to improve the quality of life are likely to identify and tackle the most prevalent problems because these problems are most sensitive to them. 2.4.6 Personal values Hemingway (2005) found that values operate at different levels and personal values act as one of the drivers of behavior. He also stated that qualitative research would be suitable in getting deeper level of understanding that how personal values may be driving social responsibility. To say that a person has a value is to say that he has an enduring prescriptive or proscriptive belief that a specific mode of behavior or end-stat of existence is preferred to an opposite mode of behavior or end-state. This belief transcends attitudes toward objective and toward situations; it is a standard that guides and determines action, attitudes toward objectives and situations, ideology, presentations of self to other, evaluations, judgments, justifications, comparisons of self with others, and attempts to influence other. Values serve as adjective, ego-defensive, knowledge and self-actualizing functions. (Rockeach, 1973, pg.25). Moreover, values is linked with ideology, which Wright stated that values will be ones guidance on differentiating what is right or wrong and finally lead to positive goals in life. (Wright, 1971). Personal Values are indentified in different levels such as individual, organizational, institutional, societal and global values (Agle and Caldwell, 1999 ). But in my studies, I will focus on individual or personal level of values.

Examining Prevalent Attitudes on Racism and the Narrative of the life of Frederick Douglass, an American Slave When we look at the issue of racism from a politically correct, nineties perspective, evidence of the oppression of black people may be obscured by the ways in which our society deals with the inequalities that still exist. There are no apparent laws that prohibit or limit opportunities for blacks in our society today, yet there is a sense that all things are not fair and equal. How can we acknowledge or just simply note how past ideologies are still perpetuated in our society today? We can examine conditions of the present day in consideration of events in the past, and draw correlations between old and modern modes of thinking. Attitudes of racism within the institutions of education, employment and government are less blatant now than in the day of Frederick Douglass, none the less, these attitudes prevail. Once Frederick Douglass had developed a reputation as a brilliant speaker he was urged to write his Narrative by one of his mentors, John A. Collins, in order to "dispel growing public doubts about his experiences as a slave."(Miller 1753) As Douglass recounts his personal circumstance the reader is informed of the main issues surrounding slavery. When we look at attitudes held by political figures around this time we get the impression it was never the ambition of the white man to integrate black slaves into society. As Supreme Court Chief Justice Taney explains in the Dred Scott Case of 1846, "{Africans slaves} were not intended to be included under the word "citizens" in the constitution and can therefore claim none of the rights and privileges which that instrument allows"(Roots of Resistance). Impact of the Computer and Internet on Parks and Recreation Management The invention of the computer and the Internet system has greatly advanced and/or changed many of the careers through out the world. Parks and Recreation Management is one of these occupations that have been able to thrive with the Internet and personal computers available today. Recreation today is becoming more and more popular due to an overall decrease in working hours. These shorten working hours leave more free time and have recently made the recreation occupation more popular. With the many national, state, and private parks in the United States, it is essential for the park systems to figure out a way to become organized and more nation-wide known due to the competition. The Internet and use of the computer became the answer to these problems. The State and National Parks System developed a database computer system that makes registration easier and faster than in the past. Instead of filling out multiple registration slips one at a time, an employee is able to type the register’s information in, and in seconds their registration slips come out neatly and accurately by computer. There is a company that takes calls for the government parks system to make reservations but recently with the discovery of the Internet, campers now are able to reserve a camping site from their own homes. This [1]park database is automatically revised every time the company, the campers, or the park rangers themselves make a reservation from the park. This keeps the state and national park system organized and more easily accessible to make reservations. With this improvement in speed and accuracy with reservations, park rangers have more time to enforce laws and regulations then being consumed with unnecessary problems in the office. Because of the increase of the populations in the state and national parks, park rangers have their hands full and cannot always be available to make reservations at the park office. This gives more face-to-face communication between park ranger and customer. Similar with other careers, the Internet has become a very useful source in Parks and Recreation Management. With their own website, the [2]national and [3]state park systems are more able to inform people about upcoming rules and regulations and new developments in different parks.

Culture of India and Western Culture

| | Mounting western culture degrading India on the whole. Have you ever seen the pictures of Jatindranath Mukerjee or Chandrasekhar Azad or Netaji Subhash Chandra Bose? Apart from being leading revolutionaries of the Indian freedom struggle, these three great personalities had something more in common. Almost in each picture you will find each of them clad in perfect Indian attire or dhoti-kurta. Do you find the same dress among Indians still? Unfortunately, it is becoming almost extinct more and more and the day is not far when its best position will be in the museum of any Indian metropolis. What inference can you draw from this lamentable specimen? Western influence is rising in the Indian society by leaps and bounds and its intensity is rising with the passing of each year almost. There is hardly any doubt that the entire course is moving contrary to the dreams of the founding fathers of independent India in August 15, 1947. They had thought that the country, winning independence after the freedom struggle of almost two centuries at a stretch, would regain its vigor and set up its basis, rooted in its own intrinsic culture, with conviction. What we are witnessing at the moment is not sad or unfortunate only but just the opposite also. Within the seven decades of national independence influences of Indian culture have started to drain almost. Even if there is any, it is under the greater protection of the western umbrella. Well, you don’t have to go anywhere else – a few glimpses of the Indian television scenario or cable television’s are going to be enough. Gone are the days when the Indian television industry used to speak in favor of national harmony, secular traditions and unity in diversity. These days, the messages of national unification have ceased to come to the fore and the programs have been replaced by reality shows dominated by women clad in skimpy dresses. These sorts of shows go against the age-old Indian traditions and in a word, affront Indian values only. But Indians are so wild that they have little time for the national stature. Is India developing then or on the wane? You have to make the decision. Culture† and â€Å"Tradition† are more significant in a country like India which has always een cherishing its rich culture and heritage and it’s quite well known for it worldwide. But these things are just on paper and are slowly losing their sheen. Why? India is known by her people. We, the younger generation are the representatives of India in a true sense of the word. Even in history, we come across various incidents where the youth took the lead to bring about a change and get India independence from the British rule. We, the Indian you th have always been the power and pride of India. We are the sole cherishers of India’s pride and its heritage which actually lies in its culture, its diversity, its uniqueness. In such a scenario, where the point of a rich cultured country like India is facing the problem of losing its culture, are we, the youth; the Indian youth not ACTUALLY RESPONSIBLE FOR THIS? Are we not putting our own self image, our self respect, our mother India’s pride at stake by doing so? Just think about it my dear friends. There is no problem as such when we follow the western culture to some extent. The problem is we are forgetting our culture to a greater extent. Why should we do so? 21st century youth doesn’t mean forgetting the motherland and following or in short adopting western lifestyle in totality. Every culture has its own pros and cons. We individuals should be strong enough to take the good and throw off the bad. But what are we doing now? It’s a shame to see that â€Å"India’s pride†; â€Å"We Indian Youth† doesn’t have even a bit of importance for India’s pride and heritage, its culture; and we are easily influenced by western culture. Right from our clothing, till the music, the films, our attitude, our lifestyle, in short every aspect of our life has totally changed. â€Å"Change doesn’t happen on its own; it’s we who bring about the change. † But by this change, our mother India has lost its sheen and beauty; its place; its uniqueness in the world. AND WE, THE INDIAN YOUTH, PRIDE OF INDIA; ARE SOLELY RESPONSIBLE FOR THAT. Friends, it’s high time now and we got to think about this now or never. â€Å"STITCH IN TIME SAVES NINE†!!!! These things have become the necessities of the Indian youth and even the older generations. A father-son duo sitting together and enjoying their drinks, women going to pubs and discos and getting involved in obscene acts and girls taking their boyfriends to their homes to have a jolly time with parents and otherwise too. What can one infer after reading the above lines? I guess, the first answer would be that India is changing over the course of time. India, as the name flickers, one thinks of religion, traditions, art and culture and it’s apt to think so because India is the country which is famous for its diversity in these aspects. The land where the great Raja Ram Mohan, Tagore, Gandhi transformed the thinking of people and removed the social stigmas like sati pratha the practice of widows being forced to sit on the pior of their husbands), untouchability and many more. India was known as â€Å"Sone Ki Chidiya† (The Golden Bird) but the shine has faded away gradually with the change in I, YOU and WE. Indian society has evolved into a mixed breed of Western and Indian culture. People are becoming too much casual in both their personal and professional lives, how a â€Å"Good Morning Madam† has now become â€Å"Hi Diksha†, how a â€Å"Namaste Daadu† has become â€Å"Hey Grandpa†, courtesy the western culture. The western culture has proved to be a setback for Indian culture, its rituals, its traditions and mannerism. The Indian morning which used to begin with bhajans and kirtans now begins with the rock of Metallica and the punk of Greenday. The age of losing virginity has gone down to teens — following the western culture, these days it has become a casual and usual trend to lose virginity as teenagers. Gender role Essay

â€Å"Bros before hos, The guy code†, is a piece by Michael Kimmel, published on the Anthology portable legacies on 2009; On this piece Kimmel explains what The guy code is and how these code defines guys masculinity in today’s society and how society expects guys to behave. Kimmel also explains that young boys are taught these rules by a male figure in their lives at a very young age and they grow up with the pressure of having to follow these rules no matter what. The guy code is a collection of rules, traits and values that make a man. â€Å"What is a man?† was the question asked to teenagers in their late teens and early 20’s. Where their answers were things like: â€Å"Boy’s don’t cry†, â€Å"Don’t get mad – Get even†, â€Å"Take it like a man†, and many more. Kimmel then proceeds and gives the four rules that have been summarized by Robert Brannon, a social psychologist of the 1970s. Some of these rules are: â€Å"No sissy stuff!†, â€Å"Be a Big Wheel†, â€Å"Be a Sturdy Oak†, â€Å"Give ’em Hell†. (655) These rules supposedly define masculinity and that one a man disobeys those rules, the risk is being bullied with words like â€Å"fagot† and â€Å"gay† that are used as an insult to describe a man’s weakness. The guy code also creates competition between most men, from playing the best sports, better jobs, pretties girl, nicer cars, etc. and it has been like this from a long time ago due to men wanting the power, respect, and that image of being better than the other man. Creating the image that all men are supposed to be unemotional, powerful and successful beings. Kimmel also claims that in the future, the guy code causes social and psychological problems for boys and young men. Renteria 2 Men have been taught this guy code ever since they were young boys; their uncles, grandpas, dad, coaches, peers or any male figure in a mans life are the ones that start tell little boys to â€Å"man up† or â€Å"don’t cry† and is no longer able to cry or show emotion, leading to their behavior in the future. The little kids learn to always hold in their emotion and to never show weakness. Kimmel then gives an example of how boys are introduced to the guy code: A three year old boy that was crying at the barbershop because he was burnt by hot chemicals. The barber said to the boys dad, he was a wimp for crying and he needed to stay away from his mom and the boys dad decided after that, his child was spending more time with him and less time with his mother because he was scared of his son  being a mamas boy. (659) As a child grows up and parents push them to be strong and tough by keeping them away from their mothers nurturing. Kimmel also talks about the â€Å"Gender Police† that is basically other guys around them who watch and judge how they act , what they wear and say even how they walk because with a little natural swing on their hips they could be called a â€Å"fag† making homosexuality seems as a weakness. The gender police makes them feel like they are ust waiting for someone else to screw up, for someone to wear something pink or acting a little bit feminine. and just putting standards for each other, forcing themselves and guys around them to create a fake cover where they act rough and manly around each other. This judgments make man feel like they are being watched because of the fear of being ridiculed and humiliated by their peers. Kimmel said that men are more about what other men think about them; however the judgment from girls because as a girl the social media taught us to be attracted to tough guys,for example in any Disney movie where the superhero is the dependable, ric h, handsome, muscular guy who takes care and provides everything for the girl, creating an idea that masculinity is success, wealth and power. Renteria 3 Peers are another big influence and problem of this â€Å"guy code†. Another example from the article is about Don,a former Lehigh College football player, who discuses the effects of always having to put up a front and act tough in front of his teammates and his coaches. He says that his coach would always make fun of or humiliate any one of his players for showing any sign of weakness or fatigue. Don says â€Å"I’m sure he thought he was building up our strength and ability to play, but it wore me out trying to pretend all the time, to suck it up and just take it.†(656) If a guy doesn’t follow the rules in the guy code he will be criticized by other man, often times bullied, and lose friends which leads to low self-stem. Men are scared of what other men will say or think about them regardless of the situation. While the Guy Code may have been meant to make men stronger it causes more harm than good turning out more self destructive in the end It causes them to grow up thinking that showing emotion is never an option, which leads them to depression, and emotion issues, aggression towards themselves and the ones around them. Kimmel’s article is really good, since it talks about a topic that need to be discussed more; it gives examples and  even talks about of where the problem begins; but it still seems quite limited to me since as Kimmel explains what the guy code is, it still does not apply to all man, for the reasons that for some guys, the guy code is just a challenge or a phase where they learn how to express their emotions, also the question that were being asked only cover white middle class man that live in a certain area, In America there’s a great variety of immigrants coming from places all around the world, also if Kimmel had questioned people from a less homophob ic part of the country, then there would be a better chance of getting a more gender equal survey. In this regard Prof. Jain & Jain rightly quoted that, â€Å"the real kernel of democracy lies in the courts enjoying the ultimate authority to restrain all exercise of absolute and arbitrary power.Without some kind of judicial p ower to control the administrative authorities, there is a danger that they may commit excess and degenerate into arbitrary authorities, and such a development would be inimical to a democratic Constitution and the concept of rule of law† . Administrative law also provides for control over administrative action by an outside agency strong enough to prevent injustice to the individual while leaving the administrative agencies adequate freedom to enable them to carry on effective administration. Administrative Action† is a very comprehensive term in which all the actions of administration are included. Administration is the meeting point of three types of government functions. The executive performs the residue of all these functions which are not vested in the two other branches of government i. e. the legislature and the judiciary. 1 Administration exercises a variety of powers. Administrative action may therefore, be legislative or judicial or neither, i. e. it could be discretionary non-judicial order or merely a ministerial act.All these functions are exercised by the administration. Administrative process in this way cuts across the traditional classification of governmental powers and combines into one, all the powers which were traditionally exercised by three different organs of state i. e. the legislature, the judiciary and the Executive. Power of Judicial control of the Administrative action may be divided under two heads in India :- (I) Judicial Control of Administrative actions by Writs: Administrative actions may be controlled by the Courts by issuing different writs under different circumstances in India.Courts through issuing different writs playing a vital role in the judicial control of administrative actions in India. Article 32(2) provides that the Supreme Court shall have power to issue directions or orders or including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari, whichever may be appr opriate for the enforcement of any of the fundamental rights 2 and for the control of the administrative action in India. This right is available only against State as defined under Article 12 of the Constitution of India.This Article provide only Original jurisdiction to the Supreme Court not the Appellate jurisdiction. Thus a person can go straight to the Supreme Court for the protection of his Fundamental rights; this jurisdiction of Supreme Court under Article 32 of the Constitution is considered as a part of the basic structure of the Constitution. Article 226 empowers the High Court to issue writs for the enforcement of the Fundamental Rights as well as for any other oppose. Article 226 provides that notwithstanding 1. C. 803. 2 anything in Article 32, every High Court shall have power throughout the territories in relation to which it exercises jurisdict ion, to issue to any person or authority including in appropriate cases any Government within those territories, directions, orders or which including writs in the nature of habeas corpus, mandamus, prohibition, quo warranto and certiorari, or any of them for the endorsement of any of the Fundamental Rights guaranteed by part III of the Constitution and for any other purpose.Both Article 32 and Article 226 provide five kinds of writs through which administrative action may be judicially controlled along with other actions. Article 226 under clause (4) made it quite clear that though both the Articles provides right of writs under the same heads, i. e. habeas corpus, mandamus, prohibition, quo warranto and certiorari, but the power conferred on a High Court by Article 226 shall not be in derogation of the power conferred on the Supreme Court by Clause (2) of Article 32.Judicial Control over administrative action is exercised through the Constitutional extraordinary remedies and statu tory ordinary remedies as well. Provisions for extraordinary remedies have been made under Article 32 and 226 of the Constitution. For controlling administrative action Supreme Court and High Court can issue the writs of habeas corpus, mandamus, prohibition, quo warranto and certiorari. A short discussion is given hereunder:Habeas Corpus: Habeas Corpus means bring the body.The writ of habeas Corpus is issued as an order calling upon the person who has detain another person to produce the detune before the Court to examine the legality of his detention. If the detune is produced before the Court and the Court finds the detention is illegal then it will order for the immediate release of the person detained illegally. The main objective of this writ is not to punish the person who has detained another person illegally but to secure immediate release of the person detained illegally whether in prison or private custody.Mandamus: The writ of mandamus is, in form, a control or command is sued by the Superior Court (the Supreme Court and High Court) to the Government, inferior court, tribunal, corporation, authority or any other person having public duty to perform asking such the Government, inferior court, tribunal, corporation, authority or any other person to perform the public duty or to refrain from doing illegal act.Thus mandamus is defined as a command issued to direct any person, corporation, inferior court or government requiring them or him to do any particular thing which he or they should do as a duty of his or their office and is in the nature of public duty or to prevent them from doing any illegal act. The purpose of this writ is to compel the performance of public duties prescribed by the statute and to keep a control over the subordinate court, Tribunal, corporation and other officers or administration exercising public duty.Certiorari: The writ of certiorari is the writ, which is issued by the Superior Court (i. e. Supreme Court or the High Court) to the inferior court or Tribunal or body exercising judicial or quasijudicial functions to remove the proceedings from such Court, Tribunal or body for examining the legality of the proceedings. If any order passed by the lower court or Tribunal or body exercising judicial or quasi-judicial functions is found to be illegal by the Superior court then the Superior court may quash or demolish it.It also controls the judicial or quasi-judicial functions of the inferior court or Tribunal or body exercising judicial or quasi-judicial functions exceeding it jurisdiction. 3 The prime aim of the writ of certiorari is to keep judicial control over the inferior courts or Tribunal or bodies functioning judicially or quasi-judicially within the limit of the jurisdiction allocated to them by the law and to prevent them from acting in excess of their jurisdiction.Prohibition : The writ of Prohibition is issued by a superior court to an inferior court or tribunal or body exercising judicial or qua si-judicial functions for preventing such inferior court or tribunal or body exercising judicial or quasi-judicial functions from uprising jurisdiction which is legally not vested to them or from acting in violation of the principles of natural justice or from acting under the unconstitutional law.The object of the prohibition is to restrain the inferior courts or tribunals or bodies exercising judicial or quasi-judicial functions from exceeding their jurisdiction. To control and keep them under the limit of their jurisdiction. Prohibition is an order of Superior courts directed to an inferior courts which forbids the court to continue proceedings in excess of its jurisdiction or in contravention of the law of the land.Quo Warranto: The word ‘Quo Warranto’ means „By what authority?. The writ of Quo Warranto is issued against a person who occupies or holds or usurps an independent sustentative office and asked him to show by what authority he claims it. The procedu re of this writ confers jurisdiction on the court to call upon the person holding an independent substantive public office or franchise or liberty to show by what right or authority he holds the said office or franchise or liberty.The unauthorized or illegal occupant of such office may be ousted by the judicial order and the person entitled to the office may be allowed to hold or occupy it. The object of this writ is to protect or control the right of the citizen through Courts from being deprived of public office to which he may have a right. By this writ the court protects the public from usurpers of the public office and control the administrative action in making appointment of the public office.Through this writ the court protects a citizen from being deprived of a public office to which he is legally entitled to hold. (II) Judicial Control of Administrative action by other than Writs: Some important aspects other than Writs also provided to the Constitution of India for the ju dicial control the administrative action in India. (i) Special Leave to appeal: The power of judicial review conferred on the Supreme Court under Article 136 is special or extraordinary in nature. This power is in the nature of a residuary reserve power of judicial review.Article 136 lays down that the Supreme Court may, in its discretion, grant special leave to appeal from any judgment, decree, determination, sentence or order in any cause or matter passed or made by any Court or Tribunal, except any Court or Tribunal constituted by or under any law relating to the Armed Forces. Since the Supreme Court has been invested with a plenary jurisdiction to hear appeals against the decisions of Administrative Tribunals and other adjudicating agencies, it is now regarded as an important mode of judicial review of administrative adjudications.But this jurisdiction is special and exercisable outside the purview of ordinary law. The Court entertains special leave only where the needs of justi ce demand its interference. 3 (ii) Supervisory Jurisdiction: The power of judicial review which has been conferred on all the High Courts under Article 227 is supervisory in nature. This supervisory power is both judicial and administrative in nature. 4 The supervisory jurisdiction conferred on the High Courts under Article 227 is in addition to the power given under Article 226 to control inferior Courts or tribunals. The supervisory jurisdiction extends to keeping the subordinate tribunals within limits of that authority and ensuring that they obey the law. The power under the article can be exercised even in those cases in which no appeal or revision lie to the High Court5.Though all the above mentioned writs and non-writs power are imp ortant weapons against state (Article 32) as well as against any detune, whether a private person or State (Article 226) for the judicial control of the administrative action in India but the main instinct for the judicial control of the administrative action by writs is the writ of ‘MANDAMUS’ and ‘QUOWARRANTO’ which are equally protective against the violation of judicial as well as administrative action, and among the other than writs power is the ‘SPECIAL LEAVE TO APPEAL’ which empowers to appeal from any judicial and administrative judgment in India. ***** Department of Law, B.
